Crypto Mining Lawsuit Filed by Green Group Against NYC

Environmentalists filed a lawsuit against a New York state agency for permitting an upstate power plant takeover by a crypto-mining corporation.

According to The Guardian, the state Public Service Commission (PSC) regulates public utilities and permitted the conversion of the Fortistar North power plant into a cryptocurrency mining site in September 2022.

The plant is located in Tonawanda, a community less than 10 miles from Niagara Falls, and was scheduled to be acquired by the Canadian cryptocurrency mining company Digihost.

Environmentalists assert that the approval breaches the 2019 climate law of New York. Among other goals, the Climate Leadership and Community Protection Act (CLCPA) establishes a reduction of 85% in statewide emissions by 2050 and the production of electricity with zero emissions by 2040.

The Clean Air Coalition of Western New York and the Sierra Club are represented in the lawsuit by the non-profit Earthjustice, which asserts that the Fortistar facility was only activated during times of high energy demand, such as during adverse weather conditions. As a cryptocurrency mining facility, however, the location would operate 24 hours a day, producing up to 3,000% greater greenhouse gas emissions.
