The Ethereum Foundation donated $1.25 million to Alexey Pertsev to support his legal proceedings. Pertsev, Tornado Cash developer, is appealing his 64-month prison sentence. Dutch authorities convicted him of money laundering for his role in creating the privacy protocol.  

The foundation defended developers’ rights and digital privacy in its statement. It emphasized that writing code is not a crime. This donation highlights growing concerns over government actions against open-source developers.  

Prosecutors Blame Developers for User Actions

Dutch authorities accused Pertsev of failing to prevent illicit transactions. They argued that he should have anticipated criminals using Tornado Cash. Prosecutors further claimed that he enabled money laundering by allowing anonymous blockchain transactions.  

Notably, this case has raised concerns among software developers. Some critics oppose the decision stating that it may potentially reduce innovation as developers bear the consequences of third parties’ actions. Legal concerns may compel developers to refrain from developing new technologies.  

Legal Battles Extend Beyond Pertsev  

Furthermore, Pertsev is not the only Tornado Cash developer facing legal trouble. U.S. authorities have also charged Roman Storm with money laundering and running an unlicensed business. Storm’s case has sparked debates about developer liability.  

Storm warned that these legal actions could harm the tech industry. He stated that developers may avoid releasing new software due to fear of prosecution. Some industry leaders believe this could slow blockchain innovation.  

Court Ruling Questions Government Sanctions  

A federal court ruled against U.S. Treasury sanctions on Tornado Cash in November 2024. The court determined that Tornado Cash’s smart contracts do not qualify as “property” under federal law. This ruling challenged the Treasury’s authority to impose sanctions.  

Former presidential candidate Vivek Ramaswamy criticized the government’s handling of the case. He argued that targeting an entire protocol instead of individual criminals is unconstitutional. The ruling may influence future regulations on decentralized technologies.
